Terms of Service

MCS Technologies provides AI-powered automation services including:

• AI Voice Receptionist and call handling systems
• Interactive chatbot solutions
• Custom website design and development
• Business email services (Office 365 and Rackspace)
• Custom automation and integration services

We reserve the right to modify, suspend, or discontinue any part of our services at any time with or without notice.

You agree to:

• Provide accurate and complete information when using our services
• Maintain the security of your account credentials
• Use our services only for lawful purposes
• Not attempt to interfere with or disrupt our services
• Not use our services to transmit harmful, offensive, or illegal content
• Comply with all applicable laws and regulations

• Services are billed on a monthly or annual basis as specified in your plan
• Payment is due at the beginning of each billing cycle
• You authorize us to charge your payment method on file
• Prices are subject to change with 30 days notice
• Refunds are provided at our discretion based on service performance
• Late payments may result in service suspension or termination

We strive to maintain 99.9% uptime for our services. However, we do not guarantee uninterrupted access and are not liable for any service interruptions, including those caused by:

• Scheduled maintenance (with advance notice when possible)
• Third-party service provider failures
• Internet or network connectivity issues
• Force majeure events beyond our control

All content, features, and functionality of our services, including but not limited to text, graphics, logos, software, and designs, are owned by MCS Technologies and protected by copyright, trademark, and other intellectual property laws.

For custom work (websites, automations), you retain ownership of your content and data. We retain ownership of the underlying code and systems unless otherwise specified in a written agreement.

Your use of our services is also governed by our Privacy Policy. We collect, use, and protect your data as described in our Privacy Policy.

You are responsible for:

• Ensuring you have rights to any data you provide to our systems
• Complying with applicable data protection laws
• Obtaining necessary consents for data you collect through our services

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MCS TECHNOLOGIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

Our total liability for any claims arising from or related to our services shall not exceed the amount you paid us in the 12 months preceding the claim.

Either party may terminate the service agreement:

• You may cancel at any time by contacting us (no refunds for partial months)
• We may suspend or terminate your account for violation of these terms
• We may terminate with 30 days notice for any reason

Upon termination, your right to use our services will immediately cease. We may delete your data after termination in accordance with our data retention policies.

Any disputes arising from these terms or our services shall be resolved through binding arbitration in accordance with the American Arbitration Association rules. You agree to waive any right to a jury trial or to participate in a class action lawsuit.

These terms shall be governed by the laws of the United States, without regard to conflict of law provisions.
